Terms of Service

These Terms of Service (“Terms”) govern your use of the WhishperLock mobile application and related services (“Service”) operated by Aaron Yang (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) and able to form a binding contract. You are responsible for compliance with local laws regarding encrypted communications and online conduct.

2. Account Registration

• You may register with email and password or Sign in with Apple.
• You must provide accurate information and keep your credentials confidential.
• You are responsible for all activity under your account.
• Notify us promptly at aaronyang470128@hotmail.com if you suspect unauthorized access.

3. Acceptable Use

You agree not to:

• Use the Service for illegal activity, harassment, threats, spam, or distribution of malware.
• Attempt to bypass encryption, access other users’ accounts, or interfere with servers or networks.
• Reverse engineer or scrape the Service except as permitted by law.
• Upload content that infringes intellectual property or privacy rights of others.
• Use the Service in a manner that could harm minors.

We may suspend or terminate accounts that violate these Terms.

4. Encryption and Your Responsibilities

WhishperLock provides end-to-end style encryption for messages, attachments, locations, and voice calls. You understand that:

• Loss of your device or credentials may affect your ability to access encrypted history.
• Recipients you share with can decrypt content you send them.
• Self-destruct timers depend on both devices and server sync; do not rely on them as a legal guarantee of deletion in all circumstances.
• You are solely responsible for the content you send and receive.

5. Subscriptions and Billing

• WhishperLock may offer a free trial and paid subscriptions (monthly or yearly) through Apple In-App Purchase.
• Payment is charged to your Apple ID account. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period.
• Manage or cancel subscriptions in Settings → Apple ID → Subscriptions on your device.
• Refunds are handled by Apple according to App Store policies.
• Prices and features may change with notice where required by law.

Apple’s Licensed Application End User License Agreement (EULA) also applies: Apple Standard EULA.

6. Intellectual Property

The App, branding, and original content are owned by Aaron Yang or licensors. Open-source components may be subject to their respective licenses (see the GitHub repository). You retain ownership of content you create; you grant us a limited license to host and transmit encrypted copies solely to operate the Service.

7. Privacy

Our collection and use of data is described in the Privacy Policy, which is incorporated into these Terms by reference.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE OPERATION.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (USD $100), WHICHEVER IS GREATER, EXCEPT WHERE PROHIBITED BY LAW.

10. Indemnification

You agree to indemnify and hold us harmless from claims arising from your use of the Service, your content, or your violation of these Terms or applicable law.

11. Termination

You may stop using the Service and delete your account at any time from the Profile screen. We may terminate or suspend access for violations of these Terms. Provisions that by nature should survive (disclaimers, liability limits, indemnity) will survive termination.

12. Changes to Terms

We may modify these Terms. Material changes will be indicated by updating the date above. Continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws applicable in the developer’s jurisdiction, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country provide otherwise.
